1. 7:10 p.m. - ZBA - Ryder/Kipp, 496 Lower Spring Street
Background - The subject lands, are located on the south side of Lower Spring
Street, have approximately 10.61 metres (34.81 feet) of frontage, and are approximately
0.11 hectares (0.28 acres) in lot area. Municipally known as 496 Lower Spring Street,
they may be legally described as Part Lot 12 and Part Lake Beach, Registered Plan
160, geographic Village of Port Stanley, now Municipality of Central Elgin.
The applicants are proposing to rezone the subject lands to permit the construction
of a new residential use. Specifically, the applicants are seeking to sever the
subject lands to build a two storey residential dwelling that will front on to West
Edith Cavell Boulevard.
There was no correspondence received and there were no questions from Council or
the public. The Public Meeting was then concluded, and the actions of Council on
the Proposed Zoning Amendment will be considered at a future meeting of Council.
2. 7:20 p.m. - ZBA - Port Stanley Harbour, 191 Carlow Road
Background - The subject lands are located on the east side of Carlow Road
and are approximately 0.94 hectares (2.33 acres) in lot area. Municipally known
as 191 Carlow Road, the subject lands do not have frontage on a street, however,
they are part of the larger municipal holdings that comprise the west side of the
Port Stanley Harbour and may be legally described as Concession 1, Part of Lot 1
Plan 49, Lots 4 and 5 North Side of Smith Street, Lots 4 and 5 South Side of George
Street, Part of Lots 1 to 5, West Side of Water Street, Part of Lots 23 to 25, East
Side of Beach Street West Pier, geographic Village of Port Stanley, now Municipality
of Central Elgin.
The Municipality is proposing to rezone the subject lands to permit a range of commercial
/ business uses including retail, restaurant and associated production uses at 191
Carlow Road for the purposes of leasing space within the existing Dominion of Canada
(DOC) building on the property.
The lands are currently zoned Industrial Zone 1 (Cl) that permits industrial - commercial
uses, office uses in connection with an industrial - commercial use, and industrial
- commercial accessory uses which is facilitating the need for a zoning by-law amendment
There was no correspondence received and there were no questions from the public.
Councillor Row asked because there was no parking or direct access to Carlow Road,
that has to be rezoned as well? Mr. McClure replied that is correct. With the zone
itself and the permited uses, there needs to be parking that's provided, but given
the fact that it's municipally owned, there is an exemption to the parking requirements
because there is the adjacent municipal parking lot. The Public Meeting was then
concluded, and the actions of Council on the Proposed Zoning Amendment will be considered
at a future meeting of Council.
