Correspondence (Action) - None

Correspondence (for Council's Information) - The Motion that Correspondence for Council's Information Items #2 - #4 inclusive be received as information and filed was put forward by Dan McNeil and seconded by Dennis Crevits, with no discussion on any Item, the Motion was Carried. Item #1 was removed from the motion and went for debate.

Harold Winkworth commented that he understands the role of the Ontario Municipal Board (OMB), but when your talking about a community, the planning in the community, and the OMB is sitting behind a desk making a decision based on the information put in front of them. I like to go look at it. The OMB should go see what some of these decisions are doing to neighbourhoods, and I totally agree that the powers should be put back in the hands of the Municipalities, and if there is legal issues, the OMB can be involved.

Dan McNeil commented that he believes in reform of the OMB, but then also the necessity to dish out a level review, over and above, of Council decisions. Every time there is a change in development, or a variance, I hear the same darn thing. If it's not Rogers Cable isn't going to work, the wind is going to blow the wrong way, or there is a drainage issue, or your going to cut down trees, or you have taken away my view. If you, as a Councillor are going to bow to emotion in every case, which, appears that you will do, and then that's why we do need a strong review above your decisions.

Mr.Leitch commented that the OMB will be holding Town Halls Meetings in London on October 27th, and there is a RSVP process to follow. A motion by Harold Winkworth and seconded by Sally Martyn that correspondence sent to the Honourable Kathleen Wynne, Premier, of the town of Aurora, respecting the Ontario Municipal Board (OMB) Reform Update be supported. The vote was taken and a majority passed the Motion, with only Dan McNeil opposed.

CEP 64-16 - Application to Amend Village of Port Stanley By-law 1507 - Bob & Ann Low, 195 Prospect Street

A motion by Sally Martyn and seconded by Harold Winkworth that Report CEP.64.16 be received; And That direction be given by Council to prepare a site-specific draft amendment to the Village of Port Stanley Zoning By-law No. 1507 to permit residential use on lands located at 195 Prospect Street, which may be legally described as Part of Lot 1. Concession 1, geographic Township of Yarmouth, now Municipality of Central Elgin; And Further That a date for a public meeting be scheduled for Monday, November 21st, 2016 at 7:20 p.m. in accordance with Ontario Regulation 545/06 as amended. The Motion was Carried.

CEP 68-16 - Application for Draft Plan of Subdivision Approval - Platinum Developments (Elgin) Ltd., Erie Heights Development Phase 4

A motion by Fiona Roberts and seconded by Harold Winkworth That Report CEP.68.16 be received; And Further That Council approve the attached municipal draft plan conditions to be forwarded to the Manager of Planning for the County of Elgin with a request that they be included in the County's decision on the proposed draft plan of subdivision Platinum Developments (Elgin) Ltd., Erie Heights Development Phase 4. The Motion was Carried.

CEP 69-16 - Application for a Consent No. E75/16 - Prespa Construction Limited - 159 St. George Street

A motion by Dan McNeil and seconded by Dennis Crevits That The Council of the Corporation of the Municipality of Central Elgin has no objections to Consent Application No. E75/16 - Prespa Construction Limited - 159 St. George Street subject to the following conditions:

  • approval of a minor variance to bring the lot frontage of the three lots into conformity with the Zoning By-law;
  • the proponent enter into a development agreement with the Municipality of Central Elgin to address administrative, technical and financial matters related to the development of the lots;
  • the payment of cash-in-lieu of the dedication of 5% of the land for parkland purposes;
  • and a copy of the reference plan be provided to the Municipality of Central Elgin;
  • and a drainage reassessment be done if necessary at the owners expense.

Previously, as a Committee of Adjustment, this approval was turned down, so this presented a problem on how to proceed. After some discussion, it was concluded that the Land Division Committee will have to make a decision on this application, regardless of what decision Council makes, so in order to have an effect on the decision Land Division Committee makes, the Committee of Adjustment decision would be included with this approval. The Motion was Carried.
